The present study aims to make an approximation to the concept of non-pecuniary damage in Spanish law because, unlike property …

2018

The article tackles the issue of digital contents’ regulation after the death of their owner, starting from the scope and content of «digital succession». It continues with the task of determining the regulatory framework concerning the devolution of both economic assets and personal or family memories stored on the Internet, under Italian Law of Succession and EU Regulation n. 650/2012 on European Certificate of Succession. Once considered the US «Revised Uniform Fiduciary Access to Digital Assets Act», the contribution also debates the development of new digital instruments and records, other than will and testament, formed by using online tools (such as Facebook «Legacy Contact»). In the…

Il diritto europeo e la «giustizia contrattuale»

2015

The essay deals with the issue of « contractual justice » in light of European private law. The author reports the extreme variety of problems brought under the formula « contractual justice » and tries to propose a definition of the notion, restricting it to the legal institutions that allow for judicial review of the contractual relationship, in view of its rebalancing. The most intricate issue concerns the conditions under which these forms of intervention, moreover very heterogeneous, can be accomplished. The paper analyzes the main opinions that range from the concepts of procedural justice to that of substantive justice, proposing a reading that goes beyond the procedural conceptions.

Teorie della coercizione, antipaternalismo e autonomia contrattuale

2013

In this article, I will examine the relations between antipaternalism and coercion theories. According to antipaternalism over himself, over his body and mind, the individual is sovereign, but if his actions are rational and free of coercion. Secondly, I will clarify if the so called unconscionability doctrine about contract law is antipaternalistic or not.

language and law in international business law

2009

The relationship between language and law is clearly apparent in international organizations. More specifically, international commercial relations show a field of analysis still remains wide clearing. The choice of language is very widely, in international trade, depending on the wish of the parties. The question of free choice is central to the study of the relationship between language and law. But the choice of language is often done without consideration of legal risks, particularly the consequences as regards the implementation and interpretation of the contract. The language issue is generally treated only as incidental, accidental, although it is necessary to comply with a certain n…

La disciplina generale del contratto- Seconda edizione

2017
